Terms of Service

PMN+ (Polynesian Music Network Plus, "PMN+," "we," "us," or "our") is part of Island City Media Group. These Terms of Service ("Terms") apply when you visit polynesianmusicnetwork.com, including the PMN+ Shop (the "Site"), buy from us, or sign up for our emails or texts. By using the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.

1. Using the Site

You may use the Site for your own personal, non-commercial use. You agree not to misuse the Site, including by interfering with its security or operation, scraping or copying it in bulk, using it for anything unlawful, or placing orders in someone else's name without permission. You must be at least 13 to use the Site, and if you are under 18 you must use it with the involvement of a parent or guardian.

2. Products and printing

Most PMN+ products are printed to order. We work to show colours, prints and details accurately, but colours on your screen may differ slightly from the finished garment, and small variations in print placement are normal. Sizes follow the size guide on each product page. Limited and exclusive releases are available while stocks last.

3. Prices and payment

All prices are in US dollars and may change at any time before you place your order. Applicable taxes and shipping are shown at checkout before you pay. Payment is taken at checkout through Shopify and our payment providers. If you choose Afterpay, your purchase is also subject to Afterpay's terms.

4. Orders and cancellations

Your order is an offer to buy. We accept it when we send your order confirmation email. We may refuse or cancel an order, in whole or in part, if an item can't be produced or is no longer available, a price or description was clearly wrong, we can't verify payment, or we suspect fraud or reselling. If we cancel, you'll get a full refund for the cancelled items. Because items are printed to order, we can only change or cancel an order before it goes to print. Email us as soon as possible if you need a change.

5. Discount codes and offers

Discount codes (such as welcome codes) and offers have no cash value and can't be exchanged for cash or applied to past orders. Unless an offer says otherwise, codes are for one use per customer and can't be combined with other codes. Offers may have expiry dates and other conditions shown with the offer. We may end or change an offer at any time and may cancel codes that are misused.

6. Shipping, returns and exchanges

We ship within the United States only. Delivery estimates, tracking, lost parcels, size exchanges and misprint replacements are covered on our Shipping and Returns & exchanges pages, which form part of these Terms. Risk of loss passes to you when your order is delivered to the carrier.

7. Accounts

If you create a PMN+ account, you are responsible for keeping your login secure and for activity under your account. Tell us right away if you think your account has been used without permission. We may suspend or close accounts that break these Terms.

8. SMS Terms (PMN+ Texts)

This section is our mobile terms of service. It applies to the PMN+ Texts program and to anyone who opts in to receive text messages from PMN+.

8.1 The program and message types

Program name: PMN+ Texts. PMN+ sends recurring automated marketing text messages (SMS and MMS) to people who opt in at the mobile number they provide. Messages may include:

Message frequency varies. You'll receive recurring messages, with more around product drops and special events. We send texts between 9am and 9pm in your local time zone.

8.3 Message and data rates

Message and data rates may apply. PMN+ does not charge for texts, but your mobile carrier may charge you to send and receive text messages, depending on your plan. Contact your carrier for details.

8.4 How to opt in

You can join PMN+ Texts by entering your mobile number in a sign-up form on our Site (such as the shop sign-up or the 20%-off pop-up) and submitting it, or by any other opt-in method we offer that shows these Terms. By opting in, you agree to receive recurring automated marketing text messages from PMN+ at the number you provided. Consent is not a condition of any purchase. You confirm you are the account holder for that number or have the account holder's permission. If you are under 18, you must have permission from a parent or guardian.

8.5 How to opt out

You can cancel at any time. Reply STOP to any PMN+ text. You can also reply CANCEL, END, QUIT, UNSUBSCRIBE or STOPALL. We'll send one final message to confirm you've been unsubscribed, and you won't receive any more marketing texts unless you opt in again. To rejoin, reply START or UNSTOP, or sign up again on our Site.

8.7 Carriers and eligibility

PMN+ Texts is available to mobile numbers in the United States on participating carriers, including most major US carriers. Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and may be affected by factors outside our control, such as network coverage or device settings.

8.8 Privacy

We handle your information as described in our Privacy Policy. We do not share or sell your mobile number or text-message opt-in consent with third parties or affiliates for their marketing purposes. We share it only with the service providers that send our messages for us (such as Klaviyo).

9. Marketing emails

If you sign up for our emails, you agree to receive marketing emails from PMN+. Every marketing email includes an unsubscribe link, and you can opt out at any time. You'll still receive emails about any orders you place.

10. Intellectual property

The PMN+ name and logo, our original designs and artwork, product photos, videos, text and other Site content belong to PMN+, Island City Media Group or our licensors, and are protected by copyright and trademark laws. You may not copy, reproduce, sell or use them without our written permission. Team, nation and event names are used to describe the communities and moments our designs celebrate. Unless a product says it is officially licensed, PMN+ is not affiliated with or endorsed by any sports team, league, tournament or governing body.

11. Your content and reviews

If you send us photos, reviews, comments or tag us on social media, you give PMN+ a non-exclusive, royalty-free right to use, share and display that content in connection with PMN+, with credit where practical. You confirm you have the right to share it, and that it doesn't break any law or anyone else's rights. We may remove content at our discretion.

12. Third-party services and links

Checkout, payments, email and text messaging, and delivery are provided by third parties such as Shopify, Afterpay, Klaviyo and shipping carriers. Your use of those services may also be subject to their terms. The Site may link to other websites and social platforms that we don't control, and we aren't responsible for their content or practices.

13. Disclaimers

The Site and its content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the Site will always be available, error-free or secure. Nothing in these Terms limits any rights you have under consumer protection laws that can't be waived.

14. Limitation of liability

To the fullest extent the law allows, PMN+ and Island City Media Group will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

15. Indemnification

You agree to indemnify and hold harmless PMN+, Island City Media Group and their team members from claims, losses and costs (including reasonable legal fees) arising from your misuse of the Site or your breach of these Terms.

16. Governing law and disputes

These Terms are governed by the laws of the State of Nevada, USA, without regard to its conflict-of-law rules. If you have a problem, please contact us first so we can try to resolve it. Any dispute that can't be resolved informally will be handled in the state or federal courts located in Clark County, Nevada, unless the law where you live requires otherwise.

17. Changes to these Terms

We may update these Terms from time to time. The latest version will always be posted on this page with its updated date. Changes apply to orders placed and texts sent after the update. Continuing to use the Site or receive texts after a change means you accept the updated Terms.
